re-organizing the system of the sale of opium. Whether this impression is correct or not, it represents the class of case to which I have always supposed that the "special merit" clause was meant to apply.

I should regard with some apprehension,

as establishing a dangerous precedent, the application of the clause to the case of an officer who, as in Mr. Jaffé's case,

has merely discharged with exceptional efficiency duties which fall within the ordinary scope of his employment and it seems to me that any engineering works must be regarded as falling within the ordinary scope of the employment of an Engineer in the Public Works Department. The proper method of dealing with cases where the work is of exceptional importance and magnitude would appear to be to grant a bonus on completion or special pay during the progress of the work.

If, however, Your Lordship considers that

the clause in question can properly be applied to such a case

there appears to be ground for regarding Mr. Jaffé as a suit-

-able subject for exceptional treatment and in that case I am

ready to invite the Executive Council to agree to the grant of

a special pension.
